What can your Homeowners Association Do?
- All homeowners that purchase a home in Marina Vista Estates, Little Elm, Texas, are required to, and become a member of the Marina Vista Estates Association (HOA). This is a community association that governs much of the “look and feel” of the community. Some homeowners believe that the HOA has the power to remedy any and all problems of the community but the power is really quite limited by jurisdiction and by the law when it pertains to individual homesteads.
- When a home is purchased, the buyers agree to a set of published rules and regulations about maintaining the status, condition, and appearance of the property.
- The HOA maintains the common areas, over ten acres of grass and trees in open greenbelts, the front portals, and the medians certain brick and stonewalls are included.
- As far as the private properties, the HOA can enforce all of the items agreed to in the DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR Marina Vista Estates (CC&R) and other published standards that every new homeowner receives before or at closing, or available on the Marina Vista Estates web site. Some items are aesthetic such as appearance, maintenance, and style. The City of Little Elm is responsible for streets, sidewalks, and signs, and CoServe Electric is responsible for the maintenance of the street lights. When the HOA receives any complaints on these areas they are forwarded to the proper offices.
- The HOA not only follows up on complaint calls from residents, but also relies on inspection tours of the property by the board members and committee members. Regular drive-bys, walk-bys, and greenbelt patrols include inspection of the community property, and all homesteads are subject to inspection for non-compliance of the CCRs.
- A letter is first sent to the owner notifying them of the problem and a request for correction. After a period of time the property is reinspected. If the infraction has not been corrected, a second letter is sent to the owner, stating that if a correction is not made, the HOA will take corrective action. If the homeowner does not correct the problem or contact the HOA to discuss and the problem and work out a solution. Ultimately, the owner will begin to incur fines and additional costs, the final - and - undesired step. The purpose is to get things fixed, not punish the homeowners. It is preferred not to fine owners, but to correct problems and keep a happy community.
